GEN 4.1 CHARGES FOR AERODROMES/HELIPORTS

1 General

1.1 The following terms used in this Subsection GEN 4 have the following meanings, unless the context otherwise requires:
  1. “Flight”: actions of an aircraft taking-off from an airport and then landing at another airport thereafter;
  2. “International flight”: a flight having a take-off or landing point located outside the territory of Viet Nam;
  3. “Domestic flight”: a flight having take-off and landing points located within the territory of Viet Nam;
  4. “Cargo (including container) with bill of lading”: cargo that has the place of shipment (origin) in Viet Nam;
  5. “Carrier”: legal entity, organization, individual who uses their owned aircraft or leased aircraft to carry cargo and passengers and general aviation;
  6. "Special flight": Special flight means a flight for totally exclusive use or for exclusive use combined with commercial carriage which is certified or notified as such by a competent state agency under regulations on special flights in accordance with the provisions prescribed in the Decree No. 125/2015/ND-CP dated December 04th 2015 of the Government stipulate in detail air traffic management;
  7. "Official-duty aircraft": Flight is carried out by the aircraft of the armed forces, customs and other State agencies on the active services.
1.2 Unit for Calculating Service Charges
a. “Maximum take-off weight (MTOW)”: maximum take-off weight specified in Operation Specification of each aircraft type;
Carriers who operate arrival/departure flights to airports and aerodromes of Viet Nam are responsible to provide the service provider with valid certifications of the MTOW of their aircrafts.
b. "Unit of cargo’s mass" (including packing):
  • The minimum weight for charge calculation of cargo security service at airports and aerodromes: Ton.
  • In a single bill of landing (under 01 ton) calculated by actual weight of the package
c. “Standard aircraft seating configuration”: the number of seats installed in the aircraft cabin to the standard set by the manufacturer.
d. Home-based airport: An airport which is designated by the Civil Aviation Authority of Viet Nam for Carriers operating in Viet Nam to have their aircraft parking overnight.
1.3 Grouping of Airports
The Airports of Viet Nam are classified into 3 groups:
  1. Group A: Airports in this group operate on a 24/24 basis: Noi Bai, Da Nang, Tan Son Nhat, Cam Ranh, Cat Bi, Vinh, Can Tho, Phu Quoc, Lien Khuong, Phu Bai and Buon Ma Thuot;
  2. Group B: All airports other than those specified in Group A and C.
  3. Group C: Airports assigned to serve economical society purposes: Con Dao, Dien Bien, Ca Mau and Rach Gia.
1.4 Classification of time frames
  1. Peak hour: The time frame in which the number of flights accounted for up to 90% of the limit of airport’s flights operation;
  2. Off-peak hour: The time frame in which the number of flights accounted for from 0% to 30% of the limit of airport’s flights operation;
  3. Normal hour: The time frame other than peak hour and off-peak hour time frames.
Note:
The Civil Aviation Authority of Viet Nam shall issue and update, revise the specific peak hours and off-peak hours at Viet Nam airports based on the operation statistic.
1.5 Provisions of charge collection
1.5.1 Currency for Payments
  1. Charges of services to international flights: US Dollar (USD). The quotation and payment of service charges under taken in accordance with the applicable regulations on foreign exchange of Viet Nam;
  2. Charges of services in domestic flights: Vietnamese Dong (VND);
1.5.2 Carrier whose aircrafts are operated to/from the airports and aerodromes of Viet Nam are responsible to make their payment for the relevant services providers before the departure of such aircrafts or make their payment in accordance with their contracts with relevant providers.
1.6 Exemption of charges
1.6.1 Flights which are exempted landing/take off charges
  1. Special flight (excluding flights operated by aircraft with a compartment reserved for or hired for Special flight purpose);
  2. Official-duty aircraft;
  3. Flights performing search and rescue missions, transporting humanitarian aids, relief and performing other humanitarian missions;
  4. Flight having to return to land at the airport of departure within 30 minutes after take-off due to any reasons.
1.6.2 Security service charges exemption is applied for
  1. Diplomatic pouches, humanitarian aids;
  2. Materials and spare–parts carried on board for repairing purposes and aircraft stores (excluding duty-free goods);
  3. Passengers on flights which are exempted at sub-section 1.6.1 above;
  4. Transit/Transfer passengers staying within 24 hours at the airport terminal (excluding Transit/Transfer passengers for connecting flight between international flights and domestic flights and vice versa): Exemption is applied only in case arrival/departure segments from Viet Nam are showed in the same Passenger Ticket and Baggage Check;
  5. Flight crew members (including those in ferry flights);
  6. Children up to the age of two years old: Calculated at the time of check-in for the first segment of departure.
1.6.3 Passengers service charges exemption is applied for
  1. Passengers on flights which are exempted at sub-section 1.6.1 above;
  2. Transit/Transfer passengers staying within 24 hours at the airport terminal (excluding Transit/Transfer passengers for connecting flight between international flights and domestic flights and vice versa): Exemption is applied only in case arrival/departure segments from Viet Nam are showed in the same Passenger Ticket and Baggage Check;
  3. Flight crew members (including those in ferry flights);
  4. Children up to the age of two years old in the first segment of departure.
1.7 Charge adjustment
The service providers are entitled to deploy the charges reduction policy for the air carrier whose total payment on the monthly invoice on the landing/take-off service charges and air navigation service charges for arrival/departure flights:

1.7.3 The service charges payment shall be calculated separately for international flights and domestic flights. The calculation period of time: 01 month.
1.8 Collection method of passenger and baggage security service charges (PSSC) and passenger service charges (PSC) at the airport.
1.8.1 PSSC (stipulated in sub-section 3.1) and PSC (stipulated in section 4) are collected by air carriers who operate flights to/from Viet Nam. Passengers shall pay for their PSSC and PSC with the air fare payment.
1.8.2 Air carriers shall pay back the collected PSSC and PSC on monthly basic to the airport operators (transfer fees will be borne by air carriers).
1.8.3 The PSSC and PSC transferred are made based on the “Request of Payment” issued by the airport operator on the “Passenger Manifest”.
1.8.4 Commission: The commission is 1.5% (including VAT) of the total of PSSC and PSC payment that airlines transferred each month.
1.8.5 Amount of excessive (-) or less (+) of payment which was verified: Upon the detection of any mistake or incorrectness in the “Request of Payment”, air carriers have the right to request the collation or verification of such mistake or incorrectness. Such collation or verification and the pay back of differential amount of money (if any) shall be undertaken in the next payment time after the timing of claim.
1.8.6 Evident to prove a passenger is entitled for charges exemption or charges reduction: The Passenger Manifest and aeronautical specialty document under the electronic forms.
1.8.7 The payment between airport operators and air carriers shall be conducted according to their mutual signed contract which details the timing and the methods of payment, the procedures and applicable time of penalty of late payment. The penalty for late payment is 0.5% of total late payment amount per week.
1.8.8 Passengers on connecting flight between domestic flights and international flights:
  1. Domestic flights: Domestic PSC and PSSC are collected at departure airport;
  2. International flights: International PSC and PSSC are collected at transit/tranfer airport.
1.8.9 Passengers on connecting flight between international flights and domestic flights: Domestic PSC and PSSC are collected at transit/tranfer airport.
A. AERONAUTICAL SERVICE CHARGES STIPULATED BY THE GOVERNMENT

2 Landing/Take-off Charges

2.1 Applicable Subject
Air carriers who have aircraft that land at the airports of Viet Nam.
2.2 Service Charges

2.2.2 Service charges fordomestic flights at theGroup A and Group B classified airports:
The service providers and user shall calculate service charges for each flight based on:
  • The frames of peak hour, off-peak hour and normal hour at airports issued by the Civil Aviation Authority of Viet Nam;
  • Flight landing time in flight permit schedule issued by Civil Aviation Authority of Viet Nam.

b) Service charges for peak hour: Charging of 115% of the charges specified in accordance with the relevant MTOW for flight landing at Point a in sub-paragraph 2.2.2 above.
c) Service charges for off-peak hour: Charging of 85% of the charges specified in accordance with the relevant MTOW for flight landing at Point a in sub-paragraph 2.2.2 above.
2.2.3 Charges for flight landing at Group C classified airports:
Charging of 60% of the charges specified for normal hour in accordance with the relevant MTOW for flight landing at Group A and B classified airports.
2.3 Charges Applicable In Some Special Cases
a. 50% of the charges specified at the sub-paragraph 2.2 abovein accordance with relevant MTOW shall be applicable to:
  • Helicopters, aircraft other than aeroplanes (conducting visual operations);
  • Aircraft deviating to an airport of Viet Nam other than its plannedairport of destination in cases of force majeure (technical, weather reasons, emergency passengers, terrorist, criminal…);
  • Aircraft performing technical landing (refuelling), do not take passengers from the airport of landing;
  • Aircraft performing test flights, ferry flights and training flights (non-commercial flights).
b. 30% of the charges specified at the sub-paragraph 2.2 aboveshall be applicable to aircraft returning to the airport of departure after more than 30 minutes not due to reasons of faults made by airport operator.
In case a fault has been made by airport operator, the Airports Corporation of Viet Nam shall negotiate with all involved parties to compensate actual expenses for the damage raised by the aircraft returning to the airport of departure.

3 Charges for Security Service

3.1 Passenger and Baggage Security Service Charges
3.1.1Applicable subject: Passengers who check-in at the terminals in the airports of Viet Nam.
a) Passenger and baggage security service charges for International flights: 02 USD per passenger.
These charges are applied for exported ticket or exchanged ticket from 00h00 dated October 01st 2017 (local time),
b) Passenger and baggage security service charges for domestic flights ( VAT included ) are as follows:

3.1.2 Charges applicable for special cases: Children with the age from 2 to 12 year old (at the time of check-in for international and domestic flights) shall be levied 50% of the service charges specified at Point a,b in sub-paragraph 3.1.1 above.
3.1.3 Passenger and Baggage Security Service Charges including:
  • Passenger, baggage security screening;
  • Security protection for aircraft;
  • Security protection for passengers of delayed or cancelled flights;
  • Oversight passengers whose entry is denied and is detained at airport within 24 hours;
  • Consolidating passenger and baggage before boarding;
  • Patrolling and guarding to ensure the public order of the airport territory.
3.1.4 Collection method of passenger and baggage security screening service charges (PSSC)
  • PSSC are collected by air carriers who operate flights to/from Vietnam. Passengers shall pay for their PSSC with the air fare payment.
  • Air carriers shall pay back the collected PSSC on monthly basic to the airport operators (transfer fees will be borne by air carriers).
  • Documents to prove a passenger is exempted or discounted of PSSC are the relevant Passenger Manifest and specific aviation document in electronic form.
  • The payment between airport operators and air carriers shall be conducted according to their mutual signed contract which details the timing and the methods of payment, the procedures and applicable time of penalty of late payment. The penalty for late payment is 0.5% of total late payment amount per week.
  • For non-scheduled flight: commission shall not be paid.
3.2 Charge for oversight passengers whose entry is denied and detained at airport over 24 hours
3.2.1Applicable subject: Carriers who have denied entry passenger, detained at airport over 24 hours.
3.2.2 Service charges:

3.2.3 Charge calculation stipulate
a) This service charge is applied for maximum 01 Security officer with auxiliary device.
b) Service time use is specified from carriers exchange to provider and hand over minutes signature till provider re-exchange to carriers and hand over minutes signature.
c) Minimum time service is 01 hour, less than 60 minutes be calculated by 01 hour. Over 10 hours be calculated by day.
Note:
  • In case passenger is detained at airport from 10 hours to 24 hours: The charge shall be calculated by 01 day. The detail is 90 USD;
  • In case passenger is detained at airport from 24 hours to 34 hours:
    Example: Passenger is detained at airport 26 hours, the charge shall be calculated by 01 day and 02 hours. The detail is 90 USD + (9 USD * 2) = 108 USD.
  • In case passenger is detained at airport from 34 hours to 48 hours: The charge shall be calculated by 02 days. The detail is 90 USD * 2 = 180 USD.
3.3 Cargo and mail security service charges
3.3.1 Applicable subject: Air carriers using security services for cargo and mail at the airports of Viet Nam.

3.5 Security service charges for vehicle entering into airport restricted areas

a. Applicable subject: Organization, individual who uses cargo, equipment vehicle to enter into airport restricted area for server.
b. Service charges: 30 000 VND/each time check-in.
c. Service including: Searching vehicle and checked security seal stamp for catering, fuel, goods for aeronautical operation before enter into air side.

4 Passenger Service Charge at airport (PSC)

4.1 Applicable Scope
Passengers checking in at the terminal in the airports, aerodromes of Viet Nam.

4.3 PSC Applicable for Special Cases
Children from the age of 2 to 12 years (at the time of check-in for the first sector if interline) shall be levied 50% of the PSC specified at the sub-paragraph 4.2.

5 Custom charges and fees for the flights to/from Vietnamese airports

5.1 Applicable Scope:

Foreign organizations and individuals operating foreign flights to the airports in Viet Nam.
5.2 Charges exemption:

a. Special flight (excluding the Special flights in combination with commercial purpose);
b. Official-duty aircraft;
c. Flights performing search and rescue missions, transporting humanitarian aids, natural disaster relief and performing other humanitarian missions;
d. Arriving flights that do not undergo customs formalities and border gate security procedure such as: aircraft performing technical landing (refuelling), or returning due to bad weather.

5.4 Charge and fee:

a. The fee on airport entry and exit: 50 USD/arriving flight.
b. The custom charge: 50 USD/arriving flight.
In case an international flight on foreign aircraft makes multiple stops in Vietnam during one voyage, the customs fee and airport entry and exit charge shall be collected only once at the first arrival airport.
5.5 Collection and submission

Payers shall pay the charge and fee before the aircraft takes off.
In case the flight adheres to a schedule, the payer shall pay the charge and fee before the aircraft takes off or on monthly basis; in other words, by no later than the 20th of the following month.
B. AERONAUTICAL SERVICE CHARGE FRAMES STIPULATED BY THE GOVERNMENT
Pursuant to the regulations on the aeronautical service prices management and charges frame prescribed hereafter, service providers at the airport shall stipulate the specific price in accordance with services quality, condition of application and market situation; enumerate, post up and publicize prices as required by the prices management law.

6 Charge frames for aircraft parking services

6.1 Applicable Scope:
Air carriers who use this service at the airports of Viet Nam.

6.3 Parking Charge Frame Applied to Air Carrier Who Choose Airports of Viet Nam as Their Home Base Airport
From October 01st 2017 to June 30th 2018: Charging of 30% of the charges specified for domestic flights at points b and d sub-paragraph 5.2 above.
From 01st July 2018: Charging of 50% of the charges specified for domestic flights at points b and d sub-paragraph 5.2 above.
The home-based airports of Viet Nam air carriers are as follows:
  • Vietnam Airlines: Tan Son Nhat, Noi Bai, Da Nang, Cam Ranh;
  • Jetstar Pacific Airlines: Tan Son Nhat, Noi Bai, Da Nang, Cam Ranh;
  • VietJet Air: Tan Son Nhat, Noi Bai, Da Nang, Cam Ranh, Cat Bi.
6.4 In case of force majeure
In case of force majeure, aircraft has to park at the airport which is not the airlines' home-based airports: Charging of 50% of the charges applied for the same type of aircraft.
6.5 Parking time
Parking time shall be a period of time between chock-on and chock-off.
Parking time from 18 to 24 hours shall be calculated as a full day; in case the aircraft park more than 24 hours but take off within the following 24 hours, a full parking day will be added. This method of calculating parking time shall be applied to the period of 24 hours thereafter.

8 Charge Frame for Check-in Counter FacilitiesRental Services

8.1 Applicable Scope:
Air carriers, ground handling service entities who use this service at the airports of Viet Nam.

8.3 Charges Frame for Other Passengers Counter Rental Service Including:
Boarding Counter, Service Desk, Transit Counter: an applicable charge of 20% of the charges specified for Check-in counter rental at Group A and Group B classified airports.
8.4 Facilities

  1. Adequate floor space for the counter;
  2. The counter itself;
  3. Computer and relevant facilities (specialized software not included);
  4. Display of counter;
  5. Conveyor attached to the counter;
  6. Electricity and water supply;
  7. Associated administrative and maintenance costs.
8.5 Using Time and Number of Counters for Each Flight
Depends on the agreement between airports and customers, based on the actual practices, capacity of airports, and air carrier’s procedures for the check-in.
8.6 In case the counter formality is used for international and domestic airports
Rental service charges is determined by the average of the monthly for international and domestic flights.

9 Charge Frame for Baggage Conveying Rental Service

9.1 Applicable Scope
Organization, individual who use the service of arrival baggage conveyor at the airports which have not equipped with the automatic baggage handling system.

10 Charge Frame for Baggage Handling and Sorting System Rental Services

10.1 Applicable Scope:
Organization, individual who use the automatic departure baggage sorting system at the airports of Viet Nam.

12.3 Applicable Terms
The above mentioned Charge Levels cover:
  1. Take-off/Landing service charges; aircraft marshaling service charges (if applicable);
  2. Technical and commercial services charges to provide flights with at least their minimum demands based on each airport’s concrete capacity.
  3. Services from Passenger Terminal’s facilities directly relating to flight services and air carrier’s office rent (excluding car parking yard).
  4. Charges for general security, luggage security screening for passengers.
  5. Aircraft parking initially free of charge.

13 Charge frames for package ground handling services at Group C classified airports

Indigenous carriers who use this service at the airports of Viet Nam.

13.3 Applicable terms

These charges include
  1. Landing/ take-off services (Calculated by 20% of package ground handling services charge); follow-me services (if any);
  2. Ground handling services for the minimum demand of flight and based on the actual capacity of each airport;
  3. Charges for using of terminal facilities in direct connection with the serving of flight and charges for air carrier’s representative office rental (excluding car parking area);
  4. Apron parking (free of charge during first two hours parking).

14 Charge frame for fuelling and for using service on fuel hydrant system at airports

14.1 Service charges frame for fuelling
a. Applicable scope: For service providers and air carriers in need of using fuelling services by truck (filled with fuel and equipped with petrol pumping system) at Vietnamese airports.

14.2 Service charges frame for using fuel hydrant system at airports
Services for using fuel hydrant system at airports shall include: fuelling services by fuel hydrant system and by truck (without fuel and only equipped with petrol pumping system).
14.2.1 Applicable scope: For service providers and air carriers in need of using fuel hydrant system at Vietnamese airports.
14.2.2 Service charges frame
a. For international flights:
- Maximum charges: 45 USD/tons;
- Minimum charges: 25 USD/tons.
b. For domestic flights:
- Maximum charges: 1.012.500 VND/tons
- Minimum charges: 562.500 VND/tons
