ENR 1  GENERAL RULES AND PROCEDURES

ENR 1.1  GENERAL RULES

All aircraft operating within the FIRs of Socialist Republic of Viet Nam shall follow the Air Traffic rules and procedures of Annexes 2 and 11 to the Convention on International Civil Aviation and the Procedures for Air Navigation Services – Air Traffic Management, and of the Regional Supplementary Procedures applicable to the South East Asia Region, except for the differences listed in GEN 1.7.

All aircraft operating within the FIRs of Viet Nam shall also abide by the Law on Civil Aviation of Viet Nam and the flight rules indicated in the Circular on Provision of Air Navigation rules indicated in the Circular on Provision of Air Navigation Management and Air Navigation Services (No.19/2017/TT-BGTVT dated JUN 06th 2017) and Circular on Amending and Supplementing a Number of Articles of Circular No.19/2017/TT-BGTVT (No. 32/2021/TT-BGTVT dated DEC 14th 2021).

1  MINIMUM SAFE HEIGHT

To be developed.

2  DROPPING OF OBJECTS

The dropping or spraying of objects out of or from aircraft in flight is prohibited, except under conditions prescribed by the appropriate authority and as indicated by relevant information, advice and/or clearance from the appropriate air traffic services unit.

3  ACROBATIC FLYING

No aircraft shall be flown acrobatically except under conditions prescribed by the appropriate authority and as indicated by relevant information, advice and/or clearance from the appropriate air traffic services unit.

4  TOWING AND ADVERTISING FLIGHTS

4.1  TOWING

Aircraft or other object shall not be towed by an aircraft, except in accordance with requirements prescribed by the appropriate authority and as indicated by relevant information, advice and/or clearance from the appropriate air traffic services unit.

4.2  FORMATION FLIGHTS

Aircraft shall not be flown in formation except by pre-arrangement among the pilot-in-command of the aircraft taking part in the flight and, for formation flight in controlled airspace, in accordance with the conditions prescribed by the appropriate ATS authority. These conditions shall include the following:

  1. The formation operates as a single aircraft with regard to navigation and position reporting;

  2. Separation between aircraft in the flight shall be the responsibility of the flight leader and the pilots-in-command of the other aircraft in the flight and shall include periods of transition when aircraft are maneuvering to attain their own separation within the formation and during join-up and break-away; and

  3. A distance not exceeding 1km (0.5NM) laterally and longitudinally, and 30m (100ft) vertically from the flight leader shall be maintained by each aircraft.

5  TIMES AND UNITS OF MEASUREMENT

Co-ordinated Universal Time (UTC) and the prescribed units of measurement shall be applied to the flight operations.

6  AIRSPACE STRUCTURE

 

7  PROHIBITED AREAS AND FLIGHT RESTRICTIONS

Aircraft shall not be flown in a prohibited area, or in a restricted area, the particulars of which have been duly published, except in accordance with the conditions of the restrictions or by permission of the state over whose territory the areas are established.

8  CLOUD FLIGHTS WITH GLIDERS

To be developed.

9  TAKE-OFFS AND LANDINGS OF AEROPLANES, ROTORCRAFT, AIRSHIPS, POWERED GLIDERS, GLIDERS AND PARACHUTISTS OUTSIDE AERODROMES ADMITTED FOR THEM

Parachute Descents

Parachute descents, other than emergency descents, shall not be made except under conditions prescribed by the appropriate authority and as indicated by relevant information, advice and/or clearance from the appropriate air traffic services unit.

10  ASCENTS OF BALLOONS, KITES, SELF-PROPELLED FLYING MODELS AND FLYING BODIES

Unmanned Free Balloons

An unmanned free balloon shall be operated in such a manner as to minimize hazards to persons, property or other aircraft and in accordance with the conditions prescribed by the appropriate ATS authority.

11  PROTECTION OF PERSONS AND PROPERTY

11.1  

An aircraft shall not be operated in a negligent or reckless manner so as to endanger life or property of others.

11.2  

Aircraft shall not be flown over the congested areas of cities, towns or settlements or over an open-air assembly of persons, except when necessary for take-off or landing, or except by permission from the appropriate authority.

12  READ-BACK OF CLEARANCES AND SAFETY-RELATED INFORMATION

12.1 The flight crew shall read back to air traffic controller safety – related parts of ATC clearance and instructions which are transmitted by voice. The following items shall always be read back:
  1. ATC route clearances;

  2. Clearances and instructions to enter, land on, take off from, hold short of, cross and backtrack on any runway; and

  3. Runway in-use, altimeter settings, SSR codes, level instructions, heading and speed instructions and, whether issued by the air traffic controller or contained in ATIS broadcasts, transition levels.

12.2 Other clearances or instructions, including conditional clearances shall be read back or acknowledged in a manner to clearly indicate that they have been understood and will be complied with.
12.3 The controller shall listen to the read-back to ascertain that the clearance or instruction has been correctly acknowledged by the flight crew and shall take immediate action to correct any discrepancies revealed by the read-back.
12.4 Unless specified by the appropriate ATS authority, voice read-back of CPDLC messages shall not be required.
